The EU’s Ministers of Economic and Financial Affairs’ Council violates the verdict by the European Communities' Court in offering a clear concession to the religious fascism in Iran at the cost of the Iranian Resistance and European judicial system

The Iranian Resistance will challenge the illegal decision


NCRI - Fifty days subsequent to the clear verdict by the   European Communities' Court of the First Instance (CFI) issued on December 12, 2006 which annulled the Council of Ministers’ decision on the People’s Mojahedin Organization of Iran (PMOI) in the framework of combating terrorism issued on December 21, 2005.

On January 30, 2007, in a press release, the  Ministers’ of Economic and Financial Affairs rejected CFI ruling and stated, “[It will] provide OMPI with a statement of reasons for maintaining it on the EU’s asset freeze list of persons, groups and entities involved in terrorists’ acts.” The statement added that it will “give [the] OMPI one month to present its views, together with any supporting documentation.”

It seems that the Ministers’ Council has all together abandoned the idea of appealing the CFI’s verdict and on the request of British government has decided to “maintain” the PMOI on the terror list.

• Second article of the court’s verdict “concludes” and clearly said, “In so far as it concerns the applicant, Council Decision is annulled.”

• Paragraph 35 of the CFI’s ruling underscored that “the annulment of the Council Decision meant that the decision did not exit in the first place and that any subsequent designation until the FCI issued its verdict would be affected by the Court's verdicts.”

• The court’s press release on December 12, 2006, on the basis of the CFI’s verdict declares, “The decision by the Council of Ministers of the European Union in so far as the OMPI is concerned must be annulled.”

The recent decision by the EU’s Council is to bypass the CFI’s verdict and maintain an annulled decision. The EU’s Council is offering an incentive to the religious fascism in Iran by clearly refusing the courts’ order and not abiding by the rule of law. It is clear that maintaining a failed policy of appeasement vis-à-vis the mullahs’ regime at the cost of the Iranian people and their resistance as well as obstructing democracy in Europe has political and economical motivations.
